Terms & Conditions

By booking any tour, trek, or travel service (in Nepal, Tibet, Bhutan, or other destinations) with Holyland Adventure Tours and Travels (“the Company”), you (“the Client”) agree to the following Terms & Conditions. These terms are legally binding upon any payment made (advance or full).


1. Booking & Contract Formation:

A booking is confirmed upon receipt of any advance payment.
Any payment (partial or full) constitutes a legally binding agreement between the client and the company.
All travellers included in the booking are bound by these Terms & Conditions.


2. Booking Process:

A minimum of 25% advance payment is required to confirm a booking.
Bookings are recommended at least 60 days before departure.
The remaining balance must be paid at least 40 days before the trip.
For bookings made within 14 days of departure, 100% payment is required.


3. Payment Methods:

Payments can be made via bank transfer, cash, or online/card payments (processing fees may apply).
All bank charges and transaction fees are the responsibility of the client.


4. Cancellation & Refund Policy:

All cancellations must be made in writing (Email or WhatsApp/Viber/WeChat).

Standard Cancellation Terms:

Strict No Refund Clause:

-Any cancellation made within 10 days of trip start date is 100% NON-REFUNDABLE

-This includes all advance payments, deposits, and partial payments

Important:

-Advance payments are non-refundable once services are booked

-Cancellation charges apply to the total trip cost or the advance paid, whichever is applicable

-No refund for no-show, early departure, or unused services


5. Non-Refundable Costs:

The following are strictly non-refundable once booked:

-Flight tickets (domestic and international)

-Trekking permits and entry fees

-Guide and porter services

-Hotel and accommodation bookings

These costs will be deducted in full regardless of cancellation timing.


6. Peak Season Policy:

During peak travel and trekking seasons (Spring and Autumn), all bookings involve pre-paid and non-recoverable commitments.
Therefore, last-minute cancellations are strictly non-refundable under any circumstances.


7. Changes & Itinerary Flexibility:

Itineraries may be modified due to weather conditions, flight delays, safety concerns, government regulations, or operational requirements.
Such changes do not qualify for refunds.


8. Responsibility & Liability:

The Company acts as a tour, trek or adventure activities organiser and is not responsible for any delays, accidents, or losses caused by factors beyond its control.
Liability is limited to the amount paid by the client.


9. Force Majeure:

The Company shall not be held liable for events beyond its control, including natural disasters, political unrest, flight cancellations, pandemics, or border restrictions.
In such cases, refunds are not guaranteed, and cancellation policies will still apply.


10. Travel Insurance:

Travel insurance is strongly recommended. Clients are responsible for their own insurance covering medical emergencies, evacuation, trip cancellation, and loss of belongings.


11. Health & Safety:

Clients must follow all instructions provided by guides and tour leaders.
Failure to comply may result in removal from the trip without refund.


12. Documents & Travel Requirements:

Clients are responsible for carrying valid passports, visas, permits, and any required travel documents.


13. Third-Party Booking Disclaimer:

If you discover or view our services through any online platform, marketplace, agent, or third-party portal, but proceed to book directly with us:

-Only our Terms & Conditions shall apply

-Any third-party platform policies shall not apply to your booking


14. Client Conduct:

The Company reserves the right to refuse or terminate services without refund if a client behaves in a disruptive, abusive, unsafe, or unlawful manner.


15. Price Changes:

Prices may change due to currency fluctuations, government taxes, supplier costs, or operational expenses.
Confirmed bookings may still be subject to adjustments in such cases.


16. Right to Cancel by Company:

The Company reserves the right to cancel bookings due to non-payment, safety concerns, or circumstances beyond its control.


17. Chargebacks & Payment Disputes:

By making a payment, the client agrees not to initiate unjustified chargebacks.
Any dispute ignoring these Terms & Conditions will be treated as a breach of contract.
The Company reserves the right to submit all supporting evidence to financial institutions.


18. Complaints:

Any complaints must be raised immediately during the trip. We will attempt to resolve issues promptly.


19. Legal Jurisdiction:

All terms and conditions shall follow the laws of Nepal, and any dispute shall be subject to the jurisdiction of the courts in Kathmandu, Nepal.


20. Final Acceptance:

By making any payment, you confirm that:

-You have read and understood these Terms & Conditions

-You agree to the strict cancellation policy

-You accept that bookings cancelled within 10 days are non-refundable
